PRIVACY STATEMENT

This privacy statement applies to A. Stait and M. Baker trading as Harbour House. Our office address is Pound Cottage, Brampford Speke, Exeter EX5 5DU

Customers.

Our customers (you) are guests who book holiday accommodation with us at Harbour House and tenants/owners of other parts of Harbour House.

A Stait  is the ‘Controller’ of any personal data we collect from you or that you provide to us in the course of conducting our business. This Privacy Statement sets out the basis on which we will process this data.

What information will we collect?

We will collect and store: your name, address, email address, phone numbers, car details, bank details for refunds, details of other guests accompanying you (including ages of children). and related correspondence and feedback/reviews.  These can be collected via written correspondence, booking forms, phone calls, emails, texts, other electronic communication or face to face meetings . They may also be collected and forwarded to us by third party websites eg Owners Direct, Homeaway, Airbnb and Simply Owners.

How will we use this information?

The purpose for collecting this information is to carry out our legitimate business.

We will use your contact details to:

  • contact you in relation to current, completed or proposed bookings or enquiries
  • send you updates on our activities
  • ask for feedback or reviews

 

We will use your comments, feedback or reviews to:

  • monitor and improve the provision of our services to you and other customers;
  • advertise our business – we will not include your name although if you review us via a third party website you may do this yourself

 

We will use the guest details and ages to:

  • monitor and improve the provision of our services to you and other customers;
  • analyse the mix of numbers of guests and patterns of repeat bookings to help improve our business

 

We will use car details

·         only in the event we need to contact you regarding the parking of your vehicle  

 

We consider these activities to represent legitimate interests in pursuing our ongoing business.

How will we process and store this information?

All data will be stored on paper booking forms/notes and in electronic format in our email and text records. This information is available to A Stait and family and M Baker. Data is stored indefinitely.

How will we share or disclose this information?

We do NOT share your information with any third-party marketing companies.

Your contact details:

  • will only be shared where we have an obligation to do so
  • or where it is practical to do so eg a tradesperson dealing with an issue during your visit

 

Guest details will not be shared outside our business.

Correspondence will not be shared.

Feedback, visitor book comments and reviews may be use for advertising without identifying you,

 

Our Data Promise

Harbour House is committed to respecting and protecting your data whilst it is in our care. We have strict policies and procedures in place to protect your data. We take your right to privacy seriously and will always seek to comply with data protection legislation.

We will not sell or transfer any personal information outside our business except where we are required to do so by law by the police or other regulatory or governmental authority.

Access to Information/Individual rights

You have the right to have data we hold on you deleted (except what we are required to keep for accounting, tax and other obligations)  and the right not to be contacted by us. You have the right to access personal information concerning you and obtain information about it, including the purposes for which it is being processed, the categories of personal data concerned and any recipients or categories of recipients of the data. This is called a subject access request (“SAR”). However, if it is felt that a request is manifestly unfounded or excessive, Harbour House may:

·         charge a reasonable fee which will take into account the administrative costs of responding;

·         ask the individual to specify the information the request relates to; or

·         refuse to act on the request.

In order to make a SAR you are required to provide information that will act as proof of identification (i.e. date of birth or NI number) and are asked to send these requests to alistait88@gmail.com   Information will be provided without delay and at the latest within 28 days of receipt. Right to Complain

If you are unsatisfied for any reason, you have the right to lodge a complaint with the supervisory authority at the Information Commissioners Office (https://www.gov.uk/data-protection/make-a-complaint).

 

Cookies

We do not knowingly use cookies. Our website www.bythecobb.co.uk does not collect any data and is only a brochure.  Our website host may collect data on how you reached our site.

 

 

 

 
ACCESS STATEMENT
 
Flat 1 is on the second floor and is accessed using two sets of stairs (12 steps plus 15 steps).  There is no lift.  Access to the roof patio is via a further staircase.  It is necessary to push open a counterweighted hatch to open the roof. 
 
Flat 2 is on the first floor (12 steps)and once inside has one step up from the kitchen into the lounge.
 
EVACUATION AIDS FOR USE IN CASE OF FIRE  (EG EVAC CHAIRS) ARE NOT PROVIDED.  THE BUILDING IS UNSUITABLE FOR THOSE WITH POOR MOBILITY

TERMS AND CONDITIONS OF HIRE 

The headings below are for guidance only and do not form part of the terms and conditions.

 

BOOKING CONDITIONS

 

The booking name and signatory given on the booking form must be over 18 years of age, must be staying in the property with the group, agrees to be responsible for the people occupying the property and is authorised to agree to the terms and conditions on behalf of all members of the group.

 

All members of the group must be named on the booking form and numbers occupying the flat must not exceed this without prior written consent. No pets are allowed in the property . (For allergy sufferers this in not to be taken as a guarantee that no animal has been in the property). No parties with non-group guests are to be held in the property or on the Flat 1 roof.

 

Consideration must be given to other occupants of the building and neighbouring properties.

 

We reserve the right to terminate the tenancy immediately and make additional charges if we become aware that the above conditions are not complied with.

 

All bookings are taken on the understanding that they are for holiday purposes only and the property must be vacated promptly at the end of the booked period.  The hirer will be liable for any costs incurred by the owner if the property is not vacated at the end of the hire period.

 

When booking please ensure that the accommodation and location is suitable for your requirements. There is no evacuation equipment and the property is not suitable for those with poor mobility. Accommodation details and access statement are on our website www.bythecobb.co.uk

 

PAYMENTS AND CANCELLATIONS

 

A non-refundable deposit of one third of the cost of the hire is required at the time of booking. (payments may vary if booking through owners direct website). The non-refundable balance is required six weeks before commencement of the hire period. If a cancellation (by email or in writing) is notified to us later than six weeks before the start of your holiday the full balance will be payable. Refunds are entirely at our discretion and dependent on whether we are able to re-let.  Please therefore ensure that you arrange holiday insurance.

 

If the final balance is not received after our reasonable attempts to contact you we reserve the right to cancel your booking with either no deposit refund or a refund at our discretion.

 

A refundable security deposit may be requested (£150 if booking is made through owners direct).  This is due two weeks before the commencement of the holiday and a refund will be sent within one week of the end of the holiday, subject to any deductions for damage, staining, or unreasonable cleaning required. 

 

Prices include all heating, light and reasonable broadband/wi-fi usage. Flat 2 prices include one parking space all year round. Flat 1 sometimes includes one parking space .  Pillows and duvets are provided but not linen and towels.  There are no extra charges for high chair, travel cot or bed guard and there is no booking fee.

 

EXTRA CHARGES

 

Small breakages (<£5) are not charged for but please report them so that replacements may be made.  The hirer is liable for the costs of other breakages, damage or staining.  Please notify us immediately of anything which may affect later visitors.

We reserve the right to make charges for extra guests not included on the booking form unless permission is sought in advance, and to terminate the tenancy immediately if we become aware that pets or extra guests are occupying the property.

 

We require re-imbursement for any bank charges we incur in respect of unpaid cheques or foreign bank transfers.

 

SAFETY CONDITIONS 

 

Hirers of the property agree:

 

-that they use the roof patio at their own risk and observe the safety advice, which is not exhaustive, shown at the foot of the stairs in the lounge and in the welcome book . In particular children will not go on the roof without adult supervision and furniture will not be left near the parapet walls.(This paragraph for Flat 1 only).

 

-that children and vulnerable adults will not be left on the exterior balconies and stairways without supervision.

 

- they are responsible for using the window locks immediately on arrival, if they think it necessary, to prevent children or vulnerable adults from falling or throwing objects from windows (keys provided).

 

- to read the safety notices and fire alarm instructions in the welcome book, on arrival.

 

No smoking or naked flames allowed inside the property.

 

Evacuation aids for use in case of fire (e.g. evac chairs) are not provided. The building is unsuitable for those with poor mobility.

 

OUR LIABILITY

 

If for reasons beyond our control, or due to genuine mistakes made by us, the property becomes unavailable or uninhabitable our maximum liability is limited to the full amount paid for the hire. Refunds will not be given if broadband/wi-fi/parking is unavailable due to circumstances beyond our control. Refunds will not be given if any equipment/appliances/furniture cannot be used due to unforeseen circumstances. Every reasonable attempt will be made to rectify any problems which arise before or during your stay.  Partial refunds for inconvenience are entirely at our discretion. The hirers should advise the owners as soon as possible of any problems encountered in the property. The owners of the property do not accept liability for any injury or loss to any person, property or vehicle or for any inconvenience or disruption from the surrounding properties or area.

 

TIMINGS

 

Unless special arrangements are agreed, the accommodation and parking (if included) for  Flat 1 will be available from 2.00pm on day of arrival until 10.00am on day of departure.

The accommodation and parking space for  Flat 2 will be available from 3.00pm on day of arrival until 11.00am on day of departure.

 

 

OTHER CONDITIONS

The property owner will be allowed access to the property at any reasonable time during occupancy and will make reasonable efforts to notify the occupants in advance, should access be necessary.

The occupiers of the property are asked to leave it in a clean and tidy condition in order for us to be able to have the property ready promptly for the next occupants. Occupiers must ensure the property locked at all times when no-one is there.

We reserve the right to reduce or increase the price of un-booked weeks at any time.
